Terms & Conditions

Effective: April 20, 2026

IMPORTANT: This app provides community-submitted information only. It is NOT a substitute for your own judgment, situational awareness, or official safety systems.

1. Acceptance of Terms

By downloading, installing, or using NeighborTrain Alert ("the App"), you ("the User") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree, you must not use the App.

2. Nature of the App

NeighborTrain Alert is a community-powered, crowd-sourced information platform. All train crossing status reports are submitted voluntarily by members of the public. The App does not receive data from any official railroad authority, government agency, traffic management system, or emergency services. All information displayed is unofficial, unverified, and may be inaccurate, outdated, delayed, or missing entirely.

3. No Guarantee of Accuracy

The developers, operators, contributors, and any associated parties of NeighborTrain Alert make no warranties, guarantees, or representations — express or implied — regarding the accuracy, completeness, timeliness, or reliability of any information provided through the App. Train crossing statuses can change in seconds. You should never rely solely on this App to determine whether a crossing is safe.

4. Limitation of Liability

To the fullest extent permitted by applicable law, the developers, owners, operators, employees, volunteers, contributors, and users of NeighborTrain Alert shall not be held liable for any damages, losses, injuries, or harm of any kind arising from the use of or reliance on this App, including but not limited to:

  • Vehicle accidents, collisions, or train-related crashes
  • Personal injury or death
  • Property damage
  • Traffic delays, missed appointments, or economic losses
  • Emergency situations of any kind
  • Incorrect, missing, or delayed status information
  • Misuse of the App by any user or third party
  • Technical failures, outages, or data loss

5. User Responsibility

You are solely and entirely responsible for your own safety and the safety of any passengers in your vehicle. You must always obey all posted railroad crossing signs, signals, gates, and applicable traffic laws. Never attempt to cross a railroad track if the signals are active, gates are down, or a train is visible, regardless of what this App displays. This App should only be used as a supplementary awareness tool, not as a primary safety guide.

6. User-Submitted Content

Users who submit train status reports acknowledge that they bear full responsibility for the accuracy and truthfulness of the information they submit. Submitting false, misleading, or harmful reports is prohibited. The developers are not responsible for false or erroneous reports submitted by any user.

7. No Emergency Services & Not for First Responder Use

This App is not an emergency service and must never be used to report, coordinate, or respond to emergencies. In the event of an emergency, call 911 immediately. For railroad emergencies, contact your local railroad operator's emergency dispatch line directly.

First responders, emergency medical personnel, fire departments, law enforcement, and dispatchers: This App is not designed, tested, certified, or intended for use in any emergency, life-safety, or time-critical scenario. The information in this App is crowdsourced from members of the public and may be inaccurate, delayed, incomplete, or entirely absent at any given moment.

  • Do not rely on this App to determine whether a crossing is clear when transporting a critical patient.
  • Do not use this App as a substitute for official dispatch channels, radio communications, or railroad coordination.
  • Do not use estimated wait times or detour suggestions from this App to make life-safety routing decisions.
  • The App does not notify hospitals, request air medical transport, contact railroad dispatch, or verify first responder credentials — and no such features should be assumed to exist.

Any use of this App by first responders or emergency personnel is done solely at their own risk, and the App's operators make no guarantee that the App will be available, accurate, or functional at any given time — especially during an active emergency.

8. Indemnification

You agree to indemnify, defend, and hold harmless the developers, owners, operators, and all associated parties of NeighborTrain Alert from and against any and all claims, damages, liabilities, costs, and expenses arising from your use of the App, your violation of these Terms, or your violation of any law or the rights of any third party.

9. Modifications

The developers reserve the right to modify these Terms and Conditions at any time. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

By using this App, you confirm that you are at least 18 years of age (or have parental consent), you have read and understood these Terms and Conditions, and you accept full personal responsibility for your safety when using this App.

These Terms apply to the NeighborTrain Alert mobile and web application.
